General Terms & Conditions for consumers


§ 1 Scope

The following terms and conditions apply to all orders placed via our online shop (eigenart.store). Our online shop is aimed exclusively at consumers. A consumer is any natural person who enters into a legal transaction for a purpose that is predominantly neither commercial nor self-employed. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or self-employed professional activity.

§ 2 Contracting party, conclusion of contract, correction options

The provisions of these GTC apply to orders which consumers conclude via the website www.eigenart.store of the online shop Eigenart.

The presentation of the products in the online shop does not constitute a legally binding offer, but only an invitation to order. You can initially place our products in the shopping basket without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained for this purpose in the order process. By clicking the button [Buy now] you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending you an order confirmation by e-mail immediately after receiving your order.

§ 3 Contract Language, Contract Text Storage

Language(s) available for the conclusion of the contract: German, English, French.

We store the text of the contract and send you the order data and our General Terms and Conditions in text form. For security reasons, the contract text is no longer accessible via the Internet.

§ 4 Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. The cost is estimated at a maximum of approximately 25,99 EUR. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Shipping costs will be added to the indicated product prices. You will find more details about the shipping costs in the offers.
We only deliver by mail order. Unfortunately, it is not possible to collect the goods yourself.
We do not deliver to packing stations.

§ 5 Prices and Shipping Costs

The prices stated on the product pages include the statutory value added tax and other price components.
In addition to the prices stated, we charge a flat rate of 15.99 € (all EU countries) and 25,99 € (UK, Switzerland and Norway) per order.
The shipping costs are clearly indicated on the product pages, in the shopping basket system and on the order page.

§ 6 Delivery Conditions

Shipping costs are added to the stated product prices. You will find more details on the amount of the shipping costs in the offers. Unless the description of a selected product explicitly states otherwise, delivery will be made within 7 working days. In the case of payment via bank transfer or Paypal, this period begins on the day after the payment order is placed.

We only deliver by mail order. It is not possible to collect the goods yourself.

We do not deliver to packing stations.

§ 7 Payment

The legal sales tax as well as other price components are included in the indicated prices. Shipping costs are not included in the displayed price and may be additional.

The following payment options are available to consumers:

Prepayment

If you choose payment in advance, we will inform you of our bank details in a separate e-mail and deliver the goods after receipt of payment.

Credit card

You enter your credit card details when placing your order. Your card will be charged immediately after placing the order.

SEPA direct debit

When you place your order, you give us a SEPA direct debit mandate. We will inform you of the date of the debit at least one bank business day in advance (so-called prenotification). A bank business day is any working day with the exception of Saturdays, national public holidays and the 24th and 31st of December each year. The account will be debited after the goods have been dispatched.

PayPal

UIn order to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, legitimise yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. You will receive further instructions in the order process.

§ 8 Reservation of proprietary rights

The goods remain our property until full payment has been received.

§ 9 Transport Damage

If goods are delivered with obvious transport damage, please complain about such defects to the delivery company as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

§ 10 Warranty and Guarantees

If you are a consumer, the warranty shall be governed by the statutory provisions.

§ 11 Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find here. Consumers have the possibility to use this platform for the settlement of their disputes.

To resolve disputes arising from a contractual relationship with a consumer or whether such a contractual relationship exists at all, we are obliged to participate in dispute resolution proceedings before a consumer arbitration board. The competent body is the Universal Arbitration Board of the Federation at the Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de. We will participate in a dispute resolution procedure before this body.
